A solution to a Real Problem - Bye, bye China – Hello America!

The Installation guys, Gary and Daniel found my cabin, which was no small thing in itself, being located at nearly 6,000 feet down a twisty, narrow road. The old refrigerators, both of which would still have been usable if some unnamed person had not turned off my electricity.

I will spare you the details of what the insides of those poor refrigerators were like.

The new refrigerator, a Frigidaire, was plugged in, set, and before you knew it Gary and Daniel were off in a puff of dust, thanks to the drought.

But the Frigidaire did not get frigid. Room temperature was all it could do. Bad news for me and for Bruce Canby, who owns Ruddy's from where the gleaming white appliance, still packed in its carton, was sent.

Bruce called me back, apologetic, with the number for the local tech. Amy, of Tony's Appliances, answered the phone. When she heard my reference number I was told they were refusing to service my call, nothing personal. This was the fourth Frigidaire from that bad lot to blight their lives this year, Amy confided.

Huh? I said. Amy explained the parts their tech was told to buy in each case cost more than the refrigerator and did not work to fix the problem. Ahhh...the penny dropped. Frigidaire has found a way to dump its bad stock and double their money.

Need I say that these units are made in China? I thought not.

Bruce, informed of this illuminating conversation, told me he would be back to me in a couple of hours with a solution which would work. He did. He and his son delivered my new refrigerator yesterday.

Bruce is a real American, one who knows what the right thing is. Quality work and service are instilled in him as values. His family has been doing business in Tulare County since they arrived to farm in 1912.

But the day was not over. My elderly Mercury Sable needed a new radiator and I had consigned it into the well known hands of Kevin at 360 Auto on Olive Street. Kevin insisted on test driving it several times and asking me questions about the symptoms which had caused me to have it trucked down the mountain by Hula Towing, just across the street from 360 Auto. The Hula Technician Corey Thomas was courteous, fast, and precise. He even picked up the key, something he did not have to do. No time was wasted.

So why, I asked Kevin, did he have to test drive it several times and ask so many questions?

Because, he said, No matter what brand you buy today they are all made in China and all too often the part does not work when you lift it out of the box to fit it in place.

What is the cost of a part if you count the cost of unnecessary parts and those which do not work? For Frigidaire this could be intentional but all careless work costs money to downstream businesses and to the buyer.

America's dominance in world markets was once founded on very different values and personal ethics, like those exemplified by Bruce, Kevin and Corey. It can be again.

Values and standards deteriorate when you do not see the impact of your choices on others. When business is local our wish to do right is less often challenged by the temptation for extra profits, and correcting the problem is much easier.

On a very real level, the meltdown America has experienced is based on core values which conflict with the corporate mission for optimizing profits.

Today America is becoming competitive with the countries which drew away our own production. While wages are still higher in the US wages in these countries are rising. Our lower costs for energy and raw materials are opening opportunities for choices.

We need to ask ourselves, now, how we want to proceed as Korea, China, and other competitors begin to open factories here to employ Americans.

Remember Jay Leno, who has the parts for his expensive antique autos 3D Printed? It does not have to be an antique car. It can be a Frigidaire or maybe even my Mercury's radiator.

3D Printing is renew local commerce and lower costs of all of us. Remember an America which understood quality and businesspeople who stood by their work? It can be so again.

Everything we use depends on parts made in China. But using 3DPrinting could make the trip across the great Pacific Pond unnecessary.

As the automobile was once a toy, so, today, do most of us view 3D Printing. This, too, can change, as it did for the automobile.

How it changes is up to us and our own choices. 3D Printing allows for local jobs, which are in effect small businesses. This can take us to a very different future.

Values matter. How happy and satisfied we are with our lives hinges on our connections to others, being respected and valued as a person.

Doing excellent work, being reliable, consistent and innovative, made Americans respected. We can do it again, beginning with 3D Printing parts for appliances and other necessities. Now, there are limits, but these can change as those expert in the technology of 3D Printing provide solutions.

Are there Americans who would be delighted to work at home making parts for local shops? Yes. Running your own small business was once the foundation on which our economy rested. The family business was business school for a generation of entrepreneurs.

These same people could also begin to repair instead of dump older appliances and machines. Look around your home. How often have you had to dump some small, or large, appliance because it stopped working? Better to make it work again, better for all of us.

Imagine for a moment getting up in the morning to see what you will be making, your specs and what is needed, having popped up on your screen. You get busy, emailing your customer to confirm you are on it and when the part will be delivered. Fast, reliable parts, produced locally, will use less energy for transport. Low energy costs are one of the reasons jobs are returning to the US today.

So lowering the cost of energy is also an avenue for changing the future. In California today we have passed parity between solar and oil as sources for energy, one of ten states to have done so.

Wipomo, a company in San Diego, is installing solar technology which allows you to power your car and use the car to generate more energy, which can then be used in your home. Their only problem is keeping up with the demand. CEO Charlie Johnson advises consumers to, “Choose energy efficient products built to last.”

And there are other technologies, waiting, which can change what we do here in Tulare County which can lower our energy costs by 50%.

How long do you think it it will be until you can buy a 3DPrinted 1957 Chevy? How long until energy is no longer an issue? The power to change direction is in our hands.

American values are founded on the choices we make as individuals. We lost sight of that, and it cost us dearly – but we can return to what works for us as individuals, for our communities, and to build a different future for our children.

4. Petitioner Courtney Ray Gillespie is a Co-Trustee of the H.M. WYSOCKI IRREVOCABLE

TRUST, who was named as a Trustee By Owner, Settlor, Trustee, & Beneficiary, Nicklas Hoffman

on 1/10/ 2005; See attached Assignment & Acceptance of Appointment of Courtney Ray

Gillespie as a Co-Trustee of the H.M. WYSOCKI IRREVOCABLE TRUST, upon first payment

for purchase of 1/2 of the Real Property at 1831 N. Lime Street, Porterville, California, attached

hereto this Petition as Exhibit 1,A, & the Acknowledgment of Receipt of payments initialed by

said Owner-Settlor, Trustee, Beneficiary, Nicklas Hoffman, in Exhibit 1B, which are hereby

incorporated by reference herein as if fully set forth, & which are hereby made a part of this

Petition, which this Court is hereby Requested to take Mandatory Judicial Notice of Pursuant to

Calif. Evid. Code Sect. 450-459, as part of the Courts Case File in this Case;

5. At no time in the past, up to the present did Nicklas Hoffman, Respondent / Defendant named

herein this Petition, ever represent to Petitioner that he was not authorized or that he lacked the

power or authority to Assign or Appoint Petitioner as a Trustee for the said H.M. WYSOCKI

IRREVOCABLE TRUST;

6. Nicklas Arthur Hoffman Respondent Defendant, is “Settler”, “Owner”, “Co-Trustee”, &

“Beneficiary” of H.M. WYSOCKI IRREVOCABLE TRUST”, who Petitioner herein alleges

created said H.M. WYSOCKI IRREVOCABLE TRUST FOR UNLAWFUL PURPOSES for

his own personal Financial Gain & Profit, while acting as a Trustee of the said Trust, in

Violation of the Law of the State of California in Probate Code Section 16004 & as set forth

HEREIN THIS PETITION IN AROUND 2004, which rendered said Trust Terminated & Void

Ab Initio, as a matter of California Law under Calif. Probate Code Section 15407(a), at the time

of its alleged Creation by Hoffman, which rendered all subsequent Acts & Actions taken in the

name of said alleged Trust by Hoffman, or anyone else, Void Ab Initio as a matter of

California Law;

7. The same said Nicklas Hoffman named herein also created “Shawn Ray Enterprise

Irrevocable Trust Organization”; New Paradigm Holding Co. Trust; & Alpha Land Co. Trust,

for the same Unlawful Purposes from the beginning, rendering those alleged “Trusts” Terminated

from the beginning by Operation of California Law under Probate Code Section 15407(a), which alleged “Trusts” are also named as Respondents Defendants in this Petition. Nancy & Allen Casselman are friends of Nicklas Hoffman, Business Partners & Trustees for Hoffman, who have

been working for Hoffman for cash money that Hoffman pays them, since around late 1990's -early 2000 Anno Domini, to be Trustees for Hoffman's Trusts named herein, for whom they provide a

remote location away from Hoffman's physical Home at 1831 N. Lime Street, Porterville, in Tulare, California, at their Business called TULARE MERCANTILE STORE at 139 East Tulare Avenue;

8. The Casselman's receive money at that location for Nicklas Hoffman through the United States

Mail, payments of Cash, money Orders, Checks, gold or silver coin, Etc., for the Commercial

products Hoffman sells through his personal Business “FIRST AMENDMENT RADIO.COM”

from his several online web pages & blogs, as well as from his Internet & Radio Broadcasts on firstamendmentradio.com.; far. com; firstamendmentradio.net, & other sister stations across the

United States, & world wide. The said Casselman's assist Hoffman in Evading Local, State, &

Federal Law requirements of paying taxes for such activities & they deposit funds received at their

Store for Hoffman into one or more Bank Accounts under another name & number, which also

helps Hoffman unlawfully avoid & evade reporting income to State Agencies required for Spousal Support & Child Support regarding his past marriages wives & children. Hoffman is required to

pay retail sales taxes & use taxes by the State of California for Operating an online Business, as

stated by the State of California on their web site for the State Board of Equalization, which web

address is: http://www.boe.ca.gov/elecsrv/efiling/sutd.htm a copy of said

web page is attached hereto as Exhibit #: ,which is incorporated herein by reference as if

fully set forth, & is hereby made a part of this Petition. The Boards web page clearly states the following about retail sales in California:

“ Sales & Use Tax

Retailers engaged in business in California must register with the BOE and pay the

state's sales tax, which applies to all retail sales of goods and merchandise except

those sales specifically exempted by law.The use tax generally applies to the storage,

use, or other consumption in California of goods purchased from retailers in

transactions not subject to the sales tax. Use tax may also apply to purchases shipped

to a California consumer from another state, including purchases made by mail order, telephone, or Internet .The sales and use tax rate in a specific California location

has three parts: the state tax rate, the local tax rate, and any district tax rate that maybe in effect. State sales and use taxes provide revenue to the state's General Fund,

to cities and counties through specific state fund allocations, and to other local jurisdictions”.

9. The Casselman's have aided Hoffman over the years in Unlawfully Evading Capitol Gains taxes

in his selling of Real Estate, & or personal Income Taxes by creating fictitious debts through bogus Mortgages set up by such bogus Trusts as New Paradigm Holding Co. Trust, claiming that the

alleged H.M.WYSCKI IRREVOCABLE TRUST Received a second Mortgage Loan from said bogus TRUST CO., ON THE 1831 N. LIME ST. Property, which they created a bogus Deed of Trust for

& Recorded it in the Tulare, County Recorders Office, which is in Exhibit #: 14 attached hereto, incorporated by reference, & made a part hereof this Petition. These false Records & Documents

Recorded by Hoffman & the Casselmans constitute a Violation of the Laws of the State of California

under California Penal Code Section 115, which is a Criminal Felony.

10. Allen Casselman has blatantly stated that the “Loan”, from “New Paradigm”, was paid off

by Hoffman & H.M. WYSOCKI IRREVOCABLE TRUST, & there was just no Re-Conveyance

Recorded, while Hoffman's Attorney has indicated in Discovery in related Case #:10-238961 that

it has not been paid off, as evidenced by the lack of any re-conveyance of the Property. Petitioner believes the real purpose & reason for said bogus Deed of Trust in favor of bogus “NEW

PARADIGM HOLDING CO.” Trust, is to create the appearance of a Cloud on the Title to

discourage other real Creditors such as local, State & Federal Taxing Agencies, past wives

& children, from trying to take the Real Property from Hoffman for back Taxes, Spousal &

Child Support, & to cause a legal problem for Petitioner herein in collecting the debt from

Hoffman or his bogus Trusts set forth in the Mechanics Lien #: 2011-0065680, which of course

are Unlawful purposes & motives by Hoffman & his Cohorts in Crime, the Casselmans, which

also render these bogus Trusts Terminated by Operation of Law under Probate Code Section

15407(a).; Petitioner herein contends that said bogus 2^nd Mortgage never occurred and no

money ever changed hands, it was all just a subterfuge by Hoffman to create the appearance

of a cloud on the Title.

11. Nancy Casseleman gives Hoffman any cash she receives, & she deposits any checks into an

Account which Hoffman can access for his personal use & benefit, which Establishes that he

personally benefits financially from the alleged Trusts as a Trustee, by Avoiding Taxes, Spousal &

Child support & uses the profits for whatever he personally chooses without any input from anyone else, establishing an unlawful purpose & Operation of Trusts, which establishes that H.M. WYSOCKI IRREVOCABLE TRUST & SHAWN RAY ENTERPRISE IRREVOCABLE TRUST ORGANIZATION, WERE TERMINATED BY OPERATION OF LAW AS FAR BACK AS

THE YEAR 2004, WHEN HOFFMAN SET UP HIS INTERNET BUSINESS AT 1831 N.

LIME STREET, & he started selling commercial products for personal profit.

12. The men in this Scheme, Nicklas Hoffman & Allen Casselman, have a pattern & Practice of assigning the Wives & or daughters or females of the family to Trustee positions, so if there is any

legal trouble with anything they can avoid personal responsibility & blame it on the females so they

will take any ramifications under the Law effectively hiding behind the females using them as

shields in a disgusting show of cowardice; The Records of the Tulare County Recorders Office show

that the said parties the Casselmans & Nicklas Hoffman have attempted to Record unlawful Transfers

of Real Property, see copies of Tulare County Recorders Office Documents in Exhibit #_8_

attached hereto & made a part hereof this Petition which Petitioner Requests the Court take

Mandatory Judicial Notice of Pursuant to California Evidence Code Section 450-459, Which

falsified Documents & Records are also a Violation of Penal Code Section 115, & which also

evidences motivation & cause for the cheap tactic employed by Nicklas & Allen hiding behind the females to avoid personal responsibility.

13. Again the Tulare County Recorders Office Records & Exhibits from the Internet attached hereto

as Exhibits ___,show that Hoffman attempted to personally sell in his personal name Nicklas

Hoffman, the real Property at 1831 N. Lime Street,Porterville, California , though, at the same time,

he was claiming in Court Documents in an alleged Quiet Title Action that a Trust owned the

Property, “H.M. WYSOCKI IRREVOCABLE TRUST ” & he was only a Co-Trustee of said Trust; Exhibit __& Discovery Responses from Hoffman in Related Case #:10-238961, show & establish

that in fact niether Hoffman or H.M. WYSOCKI IRREVOCABLE TRUST OWN TITLE TO THE REAL PROPERTY IN QUESTION, as Nickol Gerritsma an alleged Co-Trustee Transferred the

Real Property back to the Anne Minter Trust ,In Trust with a Power of Sale, along with any rents,

etc., as Security, at Exhibit #__,Tulare County Recorders Office Document #: 2004-0046800,

Recorded on 5 / 17 / 2004, which created a Mortgage on the Property, & Hoffman through his

Attorney has admitted he has not paid off that Mortgage, thus under California Law he can not

Quiet his alleged Title to that Property & his Quiet Title Action is brought in bad faith in Violation

of the Laws of California, as Hoffman has not named his Principal Creditor regarding the said Real Property purchase, Anne Minter, & Anne Minter Living Trust, who he still owes over $40,000

Dollars according to his Responses in Discovery;

14. Hoffman engages in Retail Product Sales both Online & on his Broadcasts on the Radio & online

across the State, the Country, & Worldwide. He sells monthly & yearly memberships to his web site

firstamendmentradio.com, dvds & recordings of his past broadcasts, Burkee Water Filter Systems,

& other things, such as Radio Transmitters, etc., See attached Exhibit 5 which show the Various advertisements & sales from his web sites he engages in, without paying any Local, City, County, State or Federal Taxes;

15. At the same time Shawn Ray Enterprise Trust Organization, also became Terminated by Operation

of Law as their purpose was to assist HOFFMAN in Evading Lawful payment of Local, State

& Federal Income Taxes, retail sales taxes, Capitol Gains Taxes, as well as Lawful Spousal &

Child Support Hoffman owed & still Owes to California County & State Taxing Agencies, the

Federal IRS, & to his past wives, to children of past wives, as well as in assisting HOFFMAN

in making a personal Profit off of TRUST PROPERTY, while acting as a Trustee of said

Trust, in Violation of California Law under Probate Code Sections 16004; 15407(a);

16. Hoffman created the other named Trusts New Paradigm Holding Company Trust, & Alpha

Land Co. Trust for assisting in hiding Real Property & Assets outside the reach of said Taxing

Agencies & outside the reach of his past wives & children to insure his continued unlawful profit

& gain, from the use of Trust Property while he acted as a Trustee. The unlawful purposes from

the beginning rendered said Trusts Void , Ab Initio as a matter of California Law, & the alleged

Grant Deed issued to Nickol Geritsma, in Exhibit #: 12, RECORDED on 5/17/2004 TULARE COUNTY RECORDERS OFFICE DOC.#: 2004-0046807 was also Void Ab Initio & of no

effect under California Law. All the labour, materials, tools, money, personal possessions of Petitioner Courtney Gillespie taken by Hoffman from Petitioner under false pretenses & false pretexts , as set forth herein, are held in the involuntary Trust that exists by Operation of Law

under California Civil Code Section 2223-2225 by Nicklas Hoffman who owes it all to Petitioner Courtney Gillespie.

17. Nickol Gerritsma is the Daughter of Nicklas Hoffman & purported to be a Trustee of the

H.M. WYSOCKI IRREVOCABLE TRUST, who Nicklas Hoffman has used to hide behind

by having her do all the signing for the Trust in regards to Transfers of Real property so

that his name is not involved, & he does not get Assessed any Capitol Gains Taxes by the State &

Federal Taxing Authorities, & to Evade paying local State & Federal Taxes & Spousal & Child

Support, which is yet another way the Operation of the H.M. WYSOCKI IRREVOCABLE

TRUST is Operating unlawfully & was created for that purpose by NICKLAS HOFFMAN

back in 2004 rendering it Terminated as of that time by Operation of California Law under

Probate Code Section 15407(a);

18. It Appears that Hoffman may have or had in the past a rubber stamp with his Daughters name

on it, with which he used to stamp her name on the first Certificate of Trust, in Exhibit #: 15,

which is Titled at the top “TRUST CERTIFICATE” .The stamped signature does not match

known signatures of Nickol Gerritsma, but does match other signatures of Hoffman, the first

four letters of their first names being the same (Nick). There are witnesses who will testify to

the fact that recently in the last 2-3 years when Nickol Gerritsma was served with legal papers

regarding the said alleged Trust she stated: Is my father still pulling that crap ? And further

stating that she did not have any Trust Documents, & knew nothing about the alleged Trust

which establishes again that the alleged Trust is operating Illegally & unlawfully in Violation

of the Trust Law of the State of California, as Co-Trustees are supposed to Equally Administer

& manage the Trust; Gerritsma can not be an active Co-Trustee of said Trust if she knows nothing

about the Trust in question, & has no documents or records concerning the Trust in question.

19. All named Trusts & AKA's are alleged to Exist by the named Defendants, which the named Defendants have used over the years to assist Nicklas Hoffman in carrying out his unlawfully

Illegal Schemes & activities as set forth in this Petition which was their purpose for being created from the beginning by Nicklas Hoffman, which rendered them all Terminated from the beginning by

Operation of California Law under Probate Code Section 15407(a).

20. John & Jane Does are other hidden Trusts & Entities created by NICKLAS HOFFMAN whose

names or identifying Titles are unknown by Petitioner at this Time & so Petitioner uses the Fictitious

names JOHN & JANE DOES to name & identify said Defendants /Respondents, who Petitioner

herein alleges are created for Unlawful Purposes by Nicklas Hoffman to assist Hoffman in Evading

the Payment of Local, County, State, & Federal Income Taxes, & Evading the payment of Lawful Spousal & Child Support Hoffman Owed & still Owes to Taxing Agencies & past wives & children. Petitioner will Amend this Petition with the true names of said Trusts & Entities when they are discovered by him.

PARTIES ENTITLED TO NOTICE

21. The Parties entitled to Notice of this Petition are Nicklas Hoffman, Settlor, Owner, Trustee,

& Beneficiary of the “H.M. WYSOCKI IRREVOCABLE TRUST” & Nickol Gerritsma Co-

Trustee, Nancy & Alan Castleman as Co-Trustees of Shawn Ray Enterprise Trust, Alpha

Land Co. Trust, & New Paradigm Holding Co. Trust;

JURISDICTION

22. The Principal place of Administration of the alleged H.M. Wysocki Irrevocable Trust is 1831

N. Lime Street, Porterville California which is the home & Residence of Nicklas Arthur Hoffman, the self proclaimed Owner & Trustee of said alleged Trust. Petitioner Courtney Ray Gillespie a

Co-Trustee of said alleged Trust also lives on the same land at 1831 N. Lime Street, Porterville, California. Based upon these facts the Tulare County Superior Court has Jurisdiction over this Action & over said alleged Trust & Owner-Trustee Nicklas Hoffman, Pursuant to the Express Provisions of California Probate Code Section 17000, Et Sequiter.

23. FACTS & ALLEGATIONS:

Petitioner Courtney Ray Gillespie (hereafter Petitioner, I, me) alleges & avers the following

facts & allegations in Support of this Petition:

1. I and my wife Melody Gillespie were living in Porterville California on Westwood Street

around 2003-2004. We had known Nicklas Arthur Hoffman for over 10 years from when all

three of us attended the same Church in Three Rivers Calif., the Church of Kaweia, whose

Pastor was Warren Campbell at the time;

2. Nicklas Hoffman a Defendant / Respondent herein, had a personal history of working as

General Contractor & Carpenter in the Construction field for 20 years according to his own representations. for KDNO RADIO STATION, whose owner was Richard Palmquist during that time, which broadcasted out of Delano, California during the 1990's, & for KMAK RADIO STATION, broadcasting out of LEMON COVE, CALIFORNIA, in the early 2000's, before

the operation “TRUTH RADIO” finally went off the air, around 2003-2004,due to the Negligent

Mismanagement by Nicklas Hoffman, according to some sources.

3. People involved with the said Stations have stated Hoffman stole radio equipment From

KDNO Radio, that he is now using to do his own broadcasting from 1831 N. Lime Street,

Porterville, which Hoffman calls “FIRST AMENDMENT RADIO”, from which he sells several products for money as his personal business, along with sales from his several we pages such as: Firstamendmentradio.com; Cross the Border.org; www.wwfar.com; Hoffmans said Business broadcasts in Florida, Texas, California, Minnesota, New York, Washington; & apparently

around the world internationally; See attached copies of web pages from related Broadcasts

of First Amendment Radio.com, wherein Hoffman is selling products to the Public & asking

for money to be sent to 139 E. Tulare Street, Tulare, California.

4. Nicklas Arthur Hoffman came to our house, around the end of 2003 & early 2004 to visit us,

& informed us that he had just sold his Home in Terra Bella, California which he himself had

built, & that he needed me (Courtney Gillespie) to help him move out of that house.

5. Hoffman informed Petitioner that he sold his home for 280,000 dollars & was going to put

it all in Gold with Melody Cederstrom who deals in Gold & Silver coins on his radio & internet

broadcasting show, on Hoffmans personal Business which he operates from 1831 N. Lime Street,

Porterville California, which he alleges is the Real Property owned by the “H.M. WYSOCKI

IRREVOCABLE TRUST”. The name of Hoffmans Internet Broadcasting Business is “FIRST

AMENDMENTRADIO.COM” & “FIRST AMENDMENT MEDIA GROUP”, which Hoffman

has said he Created in 1996 which he has been personally operating for profit long before the alleged creation of his alleged Trust, the “H.M. WYSOCKI IRREVOCABLE TRUST”, whom Hoffman claims owns title to the real property at 1831 N. Lime Street, Porterville California;

6. Hoffman also informed Petitioner that he had found a 10 acre piece of land (which is the property at 1831 N. Lime Street, Porterville, California)& he wanted Petitioner to have a look

at it & wanted Petitioners Opinion about the land, & also about where a water well should be

placed if he bought it. Petitioner did as Hoffman requested, & Hoffman decided he would

purchase the Property & begin drilling a well;

7. Hoffman informed Petitioner he wanted Petitioner to purchase 1/2 of the land & become a

Co- Trustee of his family Trust, upon first payment by petitioner for half of the land. Hoffman

stated that His Daughter Nickol Gerritsma, who lives on Bradley Street in Visalia, California,

with her husband & several children, was another Co-Trustee. Hoffman stated that he wanted

Petitioner to be a Co-Trustee because Petitioner had no problems with the IRS, Petitioner did

not think too much into that, at the time, & Petitioner agreed to this arrangement. The

Documents in Exhibit 1 attached hereto evidence the said agreement. At no time during any

of the several transactions between Petitioner & Nicklas Hoffman set forth herein did Hoffman

ever inform Petitioner that he was not fully authorized to act for the Trust in question: “H.M.

WYSOCKI IRREVOCABLE TRUST”, but he informed Petitioners' wife Melody Gillespie &

Petitioner at various times during this period, that he was in fact “the owner” of the “Family

Trust”, & acted & inferred that he could do whatever he wanted when ever he wanted concerning

the said “family Trust”. See Exhibit 3 which is Excerpts from Court Testimony before Judge

Glade Roper in Porterville Division of the Tulare County Superior Court Case #: PCL 138180

an unlawful Detainer Hoffman brought against Melody & Courtney Gillespie, in which the

Judgment went against him. See Excerpts from alleged Trust Documents, with yellow

highlighting which seem to indicate Hoffman was empowered to make Courtney Gillespie a

Co-Trustee, attached as Exhibit 13 hereto.

8. Hoffman informed Petitioner he wanted Petitioner to help him build his Radio Station,

Broadcasting Studio, Car Garage, & Home, & that if Gillespie did so Hoffman would help

Petitioner build his own home on his half of the land. Hoffman told Petitioner he wanted

Petitioner to put the mail box on Petitioners side of the property, & he wanted Petitioner

to put the Utilities for the whole Property in Petitioners name, which Petitioner did, & later

learned was because Hoffman did not want his former wife to find out where he was living

after selling his last home in Terra Bella California for $280,000 Dollars, to avoid paying her

any Child Support or Spousal support, which facts establish an unlawful purpose for using

the alleged Trusts in question. Hoffman invested the money in Gold with Melody Cederstrom

who sells Gold on line and has a show on Nicklas' radio internet broadcast on FIRST

AMENDMENT RADIO, & her business is located at web address : http://www.discountgoldandsilvertrading.net/

9. Petitioner entered into the agreement to purchase half the said Property in good faith, &

later realized Hoffman had ulterior motives for everything he had done, & obviously had

it all previously well thought out & planned in advance, catching Petitioner unaware that

he was such a devious manipulator & deceiver. See the written contract agreement signed

by both Nicklas Hoffman & Petitioner herein, which is attached as Exhibit 1A & 1B hereto & is incorporated herein by reference as if fully set forth herein, & is made a part of this Petition.

10. Hoffman wrongly influenced Petitioner to carryout numerous work projects for him under

the false premise that the work was in lieu of an initial down payment, though Hoffman

never stated what the value of the Original down payment was. Hoffman is personally liable in Quantum Meruit; Smith vs Bliss, C.A. 2nd 171 ; under the Express Provisions of California Probate Code Sections: 18000, Et Sequiter, as a Trustee of the H.M. WYSOCKI IRREVOCABLE TRUST,

& As the Settlor under Probate Code Section 18200, Et Sequiter to Petitioner herein for the Value

of the said work & labor performed as part of the agreement, which was obtained under False Pretenses & False Pretexts, including Fraudulent Inducement by Hoffman as set forth in this

Petition.

11. Hoffman had Petitioner Leveling the land by moving dirt around with a back loader, &

bringing in soil from another location for around ____________ days at ____ hours a day.

Hoffman had Petitioner digging trenches for laying pipe for delivering water from the well

to his home, which took about ____ days at ___ hours a day. Hoffman had Petitioner Laying

pipe for ___ days at ___ hours a day. Hoffman had Petitioner purchase or pay for the

following equipment & materials for the jobs he had Petitioner Perform under the said

agreement. Hoffman had Petitioner do various other tasks as follows:

12. When Petitioner completed his share of the work on Hoffman's Radio Station Studio & car

Garage, Hoffman moved into the Garage & studio & began broadcasting on his First

Amendment Radio shows, selling products on the air & also from his web site, in 2004 . Upon

completion of the work on Hoffman's home, Hoffman began to act different & never followed through on his promise to help Petitioner build Petitioners home on the other half of the Property.

13. In the beginning for the first several months Hoffman would always provide written receipts

for the monthly payment of the Property. Then around 12/ 1 / 2005 . Hoffman would not give a

written receipt for the payment, & thereafter Melody Gillespie, Petitioners wife would write out

a check so there would be a record of the payments. Petitioner realized Hoffman was looking for

a way out of the contract to sell him half the Property, & he was going to try to claim Petitioner

had missed payments, which was the reason he refused to give a receipt. Eventually that is what Hoffman did, he falsely claimed Petitioner had stopped paying on the property then he presumed

to declare the Contract Void, though the terms of the Contract did not allow him to do so in any circumstance;

14. Violations by Nicklas Hoffman of Calif. Probate Code Section 16004;

[Calif. Probate Section 16004(a) The trustee has a duty not to use or deal with trust property for

the trustee's own profit or for any other purpose unconnected with the trust, nor to take part in any transaction in which the trustee has an interest adverse to the beneficiary.(b)The trustee may not

enforce any claim against the trust property that the trustee purchased after or in contemplation of appointment as trustee, but the court may allow the trustee to be reimbursed from trust property the amount that the trustee paid in good faith for the claim.(c) A transaction between the trustee and a beneficiary which occurs during the existence of the trust or while the trustee's influence with the beneficiary remains and by which the trustee obtains an advantage from the beneficiary is presumed

to be a violation of the trustee's fiduciary duties. This presumption is a presumption affecting the

burden of proof. This subdivision does not apply to the provisions of an agreement between a trustee

and a beneficiary relating to the hiring or compensation of the trustee.]

15. I have been present a number of times in the past at Nancy & Allen Castlemans Store

located at 139 E. Tulare, Avenue, Tulare, California & have had discussions with the

Castlemans. I have been aware for years that Nancy Castleman is the Trustee for a Trust

Organization called Shawn Ray Enterprise , Trust, which was created by Nicklas Hoffman

where all the money for purchases of his Products sold on his Radio internet shows & on his

website go to, which funds are collected by Nancy Castleman who puts checks in a bank account

& gives cash to Hoffman. See the attached Document #: 11 of Tulare County Recorders

Office, Titled “Grant Deed” identifying “Sean Ray Enterprise” as an “Irrevocable Trust Organization.”

I do not know what Hoffman gives them for this service. These funds are for Hoffmans

personal use at his pleasure, which he is making by the use of Trust Property at 1831 N. Lime

Street, Porterville, where he conducts his personal business from in the Radio Station Studio which Petitioner helped build. Upon reflection of all the known facts in the last few years Petitioner has

come to realize that Nicklas Hoffman used him, as his unwitting accomplice, to set up a sanctuary

where he could hide his assets away from his past wives & from local city & County agencies, the California Franchise tax Board & Federal Internal Revenue Service, & that Nicklas set up the

Trust to hide behind its facade using his Daughters name on all Documents so nothing can be

traced back to him, so that he could thereby avoid any scrutiny of his personal income & profits

from real estate sales, Broadcast sales, & online sales of his products to the public, by which he

is engaged in intra state Commerce, interstate commerce, & international commerce;

16. Creation of Trust for Unlawful Purposes-Terminated by Operation of Law;

California Probate Code Section 15407 (a) (3)

15407.(a) A  trust  terminates  when  any  of  the  following  occurs:
(1) The term of the trust expires.(2) The trust purpose is fulfilled.(3)The trust purpose becomes unlawful.(4) The trust purpose becomes impossible to fulfill.(5) The trust is revoked.(b) On termination of the trust, the trustee continues to have the powers reasonably necessary under the circumstances to wind up the affairs of the trust.

17. Petitioner herein alleges & avers that Respondent Nicklas Arthur Hoffman created the alleged “H.M. WYSOCKI IRREVOCABLE TRUST” in 2004 for the unlawful purposes of using it &

using his daughter Nickol Gerritsma, (as a Trustee) to hide behind, as well as the other bogus

Trusts named herein, to hide his personal assets, including his profits from Real Estate sales

from his prior home & property which he sold for $280,000 dollars, & to hide other income & profits behind, from his Unlawful Radio & Internet Broadcasting Business called FIRST AMENDMENT RADIO, & other BUSINESSES UNDER DIFFERENT NAMES RELATED THERETO, to Evade paying Lawful Spousal & child support, to his former wives, & to Evade

paying lawful State Taxes to the California Franchise Tax Board, & to Evade paying Lawful

Federal Taxes to the Internal Revenue Service, as well as to Evade paying any Lawful local

County Taxes for Operating said Business without any State, County, or Federal License.

18. Nicklas Arthur Hoffman has been using his Daughter Nickol Gerritsma's name for signing any Real Estate documents that are Recorded in the Public Record, so they are not tracked to him personally; Gerritsma does not know what is going on in the alleged Trust & has no part

in its daily Operations or functions. Her ignorance & non-participation in the said Trust is

yet another Violation of California Law in light of the fact Hoffman uses her name as a Co -

Trustee & the Trust Law of California Expressly Requires & Mandates that Co-Trustees must Administer the Trust together, & equally share in its daily affairs & Management.

California Probate Code Section 16013 Mandates:

“16013. If a trust has more than one trustee, each trustee has a duty to do the following:(a)

To participate in the administration of the trust.(b)To take reasonable steps to prevent a cotrustee

from committing a breach of trust or to compel a co trustee to redress a breach of trust.”

This Requirement has been Violated from the very beginning of the creation of the said Trust by Hoffman & therefore has \rendered the alleged Trust Terminated from the very beginning due

to the said unlawful Operation by Hoffman, again rendering the Trust Void Ab Initio by

Operation of California Law at its inception in 2004. Hoffman has personally signed the name of

his daughter Nickol Gerritsma on various legal documents, & also has used a Rubber stamp with

her name as a Trustee, that he has used to Stamp her name on Documents such as the bogus

Certificate of Trust he Concocted in 2004 likely without her knowledge; Petitioner has documented Evidence he will bring to the hearing that will establish that more than one person has been

signing the name Nickol Gerritsma on various documents, as it appears that her name has been

used by at least three (3) different hands which Petitioner herein contends is Fraud, Impersonation, Counterfeiting, falsifying Records, etc. , Some of the documents & Records being filed in Government Offices such as the County Recorders Office & the Superior Court of the State of California in the County of Tulare, a Felony under Penal Code Section 115; it is more pattern & practice of the

Unlawful Operation of the alleged H.M. WYSOCKI IRREVOCABLE TRUST Hoffman which is

a Felony under California Penal Code Section 115, again rendering the Trust Terminated by

Operation of Law under Probate Code Section 15407.(a) rendering all Actions taken on the part of anyone in the name of the alleged Trust Void Ab Initio & of no effect under California Law.

19. As a Trustee of said alleged Trust Hoffman is not allowed to Profit from any Trust Property, which he has Violated from the very beginning of the creation of said Trust when he began

his Radio Sales & Internet Sales from the Trust Property at 1831 N. Lime Street, Porterville, California in the year 2004 Anno Domini. Hoffman has never paid taxes on any of his sales which

are “Retail” sales taxable under State Law. He has never applied for any Tulare County Business

license to broadcast & sell goods out of Trust Property at 1831 N. Lime Street, Porterville,

California. Hoffman never reported the increases in his Income & his Profits from Real Estate

sales to the Family Law Agency regarding his former divorces from former wives, & owes said

former spouses back payments due to said omissions to report personal income & profits.

20. Hoffman continues at present to carry on these unlawful businesses & sales from Trust Property, without paying lawful Taxes, spousal or child Support, & unlawfully profiting from Trust Property

in Violation of California Probate Code Section:16004 (a);

[The trustee has a duty not to use or deal with trust property for the trustee's own profit or for any

other purpose unconnected with the trust, nor to take part in any transaction in which the trustee

17. PRAYER FOR RELIEF;

1. Wherefore Petition herein Prays to the creator of the Universe for the following Relief:

(1) This Court hears the accompanying Motion for An Order Consolidating this Case with Case

#:10-238961, Pursuant to the Express Provisions of Calif. Code of Civil Procedure Section

1048 & thereafter issues an Order Granting that Motion, & issues an Order Consolidating

Case #:10-238961 with this Petition & Trails any Trial on the Cross Action for Quiet Title

behind the hearing of this Petition until a final Ruling & Judgment on the matters raised in

this Petition that adversely affect the said Cross Action of Cross Complainants, and;

(2) This Court issues a Declaration of an Involuntary Trust by Operation of Law, pursuant to

the Express Provisions of California Civil Code Sections 2223-2225, against: Settler, Owner,

Co-Trustee & Beneficiary Nicklas Arthur Hoffman, for the “H.M. WYSOCKI IRREVOCABLE

TRUST”; Trustees Nancy & Allen Castleman for the Sean Ray Enterprise Business Trust,

for Alpha Land Co. Trust, & for New Paradigm Holding Company, Trust, making Hoffman

Trustee of said involuntary Trust, responsible for all personal property, funds, assets,

equipment, tools, fruit of the labor of Courtney Gillespie which Hoffman has taken possession

of since the year 2004, up to the present time, March of 2013, in favor of Petitioner Courtney

Ray Gillespie as Beneficiary of said Involuntary Trust Pursuant to the Mechanics Lien of

Petitioner Courtney Ray Gillespie Recorded in the Tulare County Recorders Office on 10/19/

2011, Document #: 2011-0065680 which is in Exhibit # 2 & is made a part of this Petition;

(3) This Court issues an Order Compelling Trustee Nicklas Arthur Hoffman to provide a copy
of the Terms of the “H.M. WYSOCKI IRREVOCABLE TRUST”, Pursuant to Calif. Probate
Code Section 1700(1); Calif. Probate Code Sect. 17200, to Petitioner Trustee Courtney Ray
Gillespie;

(4) This Court issues an Order for a Full Accounting of Trust funds & Assets to Assist in

Determining the ability of the Trust & or Settler, Co-Trustee Nicklas Hoffman to pay

Damages to Trustee Courtney Gillespie upon Judgment for Enforcement of Mechanics Lien

#:2011-0065680, RECORDED ON 10/19/2011 IN THE TULARE COUNTY RECORDERS

OFFICE, Pursuant to Calif. Civil Code Sect. 8400 Et Sequiter, COPY OF LIEN IN EXHIBIT

# 2; ATTACHED HERETO THIS PETITION & MADE A PART HEREOF;

(5) The Court makes a Determination of the Existence of the“H. M. Wysocki Irrevocable Trust”,

“SHAWN RAY ENTERPRISE PURE BUSINESS TRUST” AKA “IRREVOCABLE TRUST

Probate Code Sect. 15407(a) & Void Ab Initio due to Unlawful Purpose from the beginning
& an Order for full Accounting, Examination, & Distribution of any funds in possession of
any of these Trusts in any Bank Accounts , & an Order directing sale of any real property
in Possession of any of these Trusts, for payment of the Debts set forth in Mechanic Lien
# 2011-0065680, in Exhibit # 2 attached hereto, & made a part hereof this Petition;

(7) Judgment against Nicklas Arthur Hoffman in his Capacity as Settlor & Trustee & in his

personal Capacity for Damages set forth herein, including Judgment for Enforcement of

Tulare County Recorders Office Mechanics Lien #: 2011-0065680, RECORDED ON 10/

19/2011 IN THE TULARE COUNTY RECORDERS OFFICE, Pursuant to Calif. Civil

Code Sect. 8400 Et Sequiter, by Trustee Courtney Ray Gillespie, in the amount set forth in

the Mechanics lien attached as Exhibit 2 to this Petition, or in an amount the Court deems

right & proper under all the facts law & equities of this Case;

(8) An Order Granting a Stay of Execution of any Judgment Obtained by Cross Complainants

in Case #: 10-238961, Pursuant to Calif. C.C.P. Section 918.5(a) based upon the off set –

set off claim of Petitioner Courtney Ray Gillespie herein, in this Petition & in his Attached

Mechanics Lien, #: 2011-0065680 Recorded October 19, 2011, in the Tulare, County

Recorders Office, in Exhibit #: 2 attached hereto, which is made a part of this Petition;

(9) The Court issues a further Order that all Court Actions purportedly filed by “H.M.

WYSOCKI IRREVOCABLE TRUST” are VOID AB INITIO, & THE SAME SHALL BE

TREATED AS IF THEY WERE NEVER FILED;

(10) This Court allows Court Costs & Fees to Petitioner herein, and;

(11) This Court Grants whatever other relief it deems right & Proper under all the facts, Law,

& Equities of this Case.
